Anchoring Services ("Anchoring Services," "we," "us," or "our") is committed to protecting the privacy of
every person who visits our website at www.anchoringservices.com (the "Site") or interacts with our online
services nationwide. This Website Privacy Policy explains what information we collect, how we use it, how we
protect it, and your rights as a visitor or prospective client.


This policy applies to website visitors and prospective clients across all U.S. states. It covers our general
website operations and marketing data practices. It is separate from — but consistent with — our HIPAA Notice of Privacy Practices, which governs how we handle protected health information (PHI) for active clients.


IMPORTANT: If you are a current or former client of Anchoring Services, your therapy records, session data, and health information are protected under a separate HIPAA Notice of Privacy Practices provided at intake. This Website Privacy Policy does not alter or replace those HIPAA protections.

SECTION 1: INFORMATION WE COLLECT

1.1 Information You Provide Directly
We collect personal information that you voluntarily submit through our website, including:

  • Contact forms: Name, email address, phone number, and any message content you submit.

  • Newsletter signup: Name and email address when you opt in to receive communications from us.

  • Lead magnets and downloadable resources: Name and email address exchanged for free resources, guides, or workshop registrations.

  • Client portal enrollment (SimplePractice): When you begin the intake process, you are directed to our secure SimplePractice portal at anchoringservices.clientsecure.me, which operates under its own Privacy Policy and Business Associate Agreement (BAA) with Anchoring Services.

  • Inquiry emails or phone calls: Any personal details you share when contacting us directly.

 

1.2 Information Collected Automatically
When you visit our Site, certain information is collected automatically through cookies, pixels, and analytics tools:

  • Wix Analytics: Our website is hosted on Wix, which automatically collects usage data including pages visited, time on site, device type, browser type, and approximate geographic location (city/region level).

  • Google Reviews integration: If you interact with our Google Business Profile widget or reviews embedded on our Site, Google may collect data under Google's own Privacy Policy.

  • Meta Pixel (Facebook/Instagram): We may use the Meta Pixel to measure the effectiveness of our advertising and to understand how visitors interact with our Site. The Meta Pixel may collect data about your visit and connect it to your Facebook or Instagram account if you are logged in. You can opt out at www.youronlinechoices.com or via your Facebook ad settings.

  • LinkedIn Insight Tag: We may use LinkedIn's Insight Tag to track conversions from LinkedIn ads, retarget website visitors, and gather analytics about our Site's audience. LinkedIn may set cookies to enable this tracking. You can opt out at www.linkedin.com/psettings/guest-controls.

  • Cookies: Our Wix-hosted site uses cookies — small text files stored on your device. These may include essential cookies (required for site function), analytics cookies, and advertising cookies. You can manage cookie preferences through your browser settings. Note that disabling certain cookies may affect site functionality.

  • IP address and device identifiers: Automatically logged for security and analytics purposes.

1.3 Information About Minors
Anchoring Services provides services to children ages 3–12 through licensed clinicians. We do not knowingly
collect personal information directly from children under age 13 through this website.
All information about
minor clients is provided by a parent or legal guardian, and is collected through our secure SimplePractice intake
portal — not through general website forms. If you believe a child has submitted personal information through our
website without parental consent, please contact us immediately at info@anchoringservices.com so we can
promptly delete it.


This practice is consistent with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506.

SECTION 2: How We Use Your INFORMATION

We use the information we collect for the following purposes:

 

  • To respond to your inquiries and provide information about our services

  • To match you with an appropriate clinician based on your needs, insurance, location, and preferences

  • To send newsletters, wellness content, or practice updates — only if you have opted in

  • To send lead magnet resources you requested, and periodic relevant follow-up communications

  • To measure and improve the performance of our website and marketing campaigns

  • To run targeted advertising on Meta (Facebook/Instagram) and LinkedIn platforms

  • To track referral sources so we can understand how clients find us and improve outreach

  • To comply with legal and regulatory obligations

  • To protect the safety and security of our website and communications
     

We will NEVER sell your personal information. We will NEVER use website-collected information to make decisions about your clinical care, diagnosis, or treatment. All clinical information is handled exclusively through our HIPAA-compliant systems.

SECTION 3: Email Marketing & Communications

We currently use KIT (formerly ConvertKit) as our email marketing platform, with plans to transition to an
upgraded platform in the future. When you sign up for our newsletter, download a resource, or opt in to
communications, your name and email address are stored in our email platform.

  • Consent: You will only receive marketing emails if you have expressly opted in.

  • Unsubscribe: Every marketing email includes an unsubscribe link. You may opt out at any time.

  • Data transfer: Your email and name may be transferred to and stored by our email marketing platform (KIT), which has its own privacy policy. Data may be stored on servers outside your state but within the United States.

  • No health information in marketing emails: We never include protected health information in marketing communications.

SECTION 4: Telehealth Technology Disclosures

Anchoring Services provides telehealth therapy services to clients in Minnesota and Massachusetts. Our primary
telehealth platform is
SimplePractice, which is HIPAA-compliant and covered under a Business Associate
Agreement (BAA). In limited circumstances where technical difficulties arise, we may use
Zoom for Healthcare or
Microsoft Teams, both of which support HIPAA-compliant configurations.


These platforms are used for clinical sessions only — never for general marketing, lead generation, or data
collection purposes. Any data collected during a telehealth session is governed by our HIPAA Notice of Privacy
Practices, not this Website Privacy Policy.

SECTION 5: How We Share Your Information

We do not sell your personal information. We may share information with:
 

  • Service providers: Trusted vendors who help us operate our business (Wix, SimplePractice, KIT/email platform, Google, Meta, LinkedIn) under contractual obligations to protect your data.

  • Business Associates (HIPAA): Any vendor with access to protected health information signs a Business Associate Agreement with us.

  • Legal compliance: If required by law, court order, or government authority, we may disclose information as legally required.

  • Safety: If we believe disclosure is necessary to prevent serious harm to you or others.

  • Business transfer: In the event of a merger, acquisition, or sale of our practice, your information may transfer to the successor entity, subject to the same privacy protections.

SECTION 6: Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information, including:

  • Use of HIPAA-compliant, encrypted platforms (SimplePractice) for all clinical data

  • Secure fax via Spruce Health for protected communications

  • Staff training on privacy and data handling practices

  • Password-protected systems and role-based access controls

  • Regular review of our data security practices

No method of electronic transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. SECTION 7: Data retention

  • Website inquiry and marketing data (contact forms, newsletter, lead magnets): Retained for as long as reasonably necessary to fulfill the purpose collected or until you request deletion.

  • Clinical records (SimplePractice): Retained for a minimum of 7 years following the last date of service, per Minnesota law (MN Rules 2150.7535) and applicable Massachusetts regulations. Records for minors are retained until the client reaches age 25 or for 7 years after the last date of service, whichever is longer.

  • Email marketing data: Retained until you unsubscribe or request deletion.

  • Analytics and cookie data: Governed by respective platform policies (Wix, Google, Meta, LinkedIn).

SECTION 8: State-Specific Privacy Rights

The following section outlines your state-specific privacy rights. Because Minnesota and Massachusetts share significant overlap in mental health privacy protections and general data rights, we have combined these states where laws are substantively similar. Where laws differ materially, we have separated them into distinct subsections.

Rights Shared by Minnesota and Massachusetts Residents

 

Mental Health Information — Heightened Protection

Both Minnesota and Massachusetts provide heightened protections for mental health records beyond standard HIPAA requirements. Mental health records — including therapy session notes, diagnoses, and treatment information — may not be disclosed without your specific written authorization, except in narrow legally defined circumstances (imminent danger, court order, mandatory reporting of child abuse/neglect, etc.).

 

  • You have the right to access your own mental health records upon written request.

  • You have the right to request correction of inaccurate information in your records.

  • You have the right to know to whom your records have been disclosed.

  • Your records will not be shared with employers, schools, or family members without your written authorization, except as required by law.

General Website Data Rights (Both States)

Regardless of where you live, all Anchoring Services website visitors have the right to:

  • Know what personal information we collect about you through this website.

  • Access personal information we hold about you by submitting a written request to info@anchoringservices.com.

  • Delete personal information collected through website forms or marketing lists (not clinical records, which have mandatory retention requirements).

  • Opt out of marketing emails at any time via the unsubscribe link or by contacting us.

  • Opt out of targeted advertising by adjusting settings on Meta, LinkedIn, and Google platforms.

  • Non-discrimination: We will not discriminate against you for exercising any privacy rights.

​Minnesota-Specific Provisions
 

Minnesota Health Records Act — Minn. Stat. §§ 144.291–144.298

Minnesota law provides some of the strongest mental health privacy protections in the country. Under the Minnesota Health Records Act:

​

  • Mental health records are defined broadly and include any information created or maintained by a health care provider that relates to the past, present, or future physical or mental health of a patient.

  • You have the right to access your complete health record within 30 days of a written request (or 10 business days if records are maintained electronically).

  • You may request that your records not be disclosed to specific individuals or entities (subject to legal limitations).

  • We are required to maintain a log of disclosures made without your authorization.

  • Psychotherapy notes receive special additional protection and require a separate, specific authorization — distinct from general medical record authorization.

Minnesota Consumer Data Privacy Act (MCDPA) — Effective July 31, 2025
Minnesota's Consumer Data Privacy Act grants residents of Minnesota the following rights regarding personal
data collected by our website:​

 

  • Right to Know: You may request confirmation of whether we process your personal data and access a copy of that data.

  • Right to Correct: You may request correction of inaccurate personal data.

  • Right to Delete: You may request deletion of personal data we collected from you (subject to legal retention obligations).

  • Right to Data Portability: You may request a portable copy of your personal data in a commonly used format.

  • Right to Opt Out: You have the right to opt out of (a) targeted advertising, (b) sale of personal data, and (c) profiling that produces legal or similarly significant effects. We do not sell personal data.

  • Right to Appeal: If we deny your privacy request, you may appeal by contacting us in writing within 30 days of our decision.

Minnesota Mandatory Reporting

Anchoring Services clinicians are mandated reporters under Minnesota law (Minn. Stat. § 626.556 and § 626.557). We are required to report suspected maltreatment of minors and vulnerable adults to the appropriate authorities, regardless of confidentiality protections. This is a legal obligation, not a discretionary disclosure.

Massachusetts-Specific Provisions

Massachusetts Mental Health Confidentiality — M.G.L. c. 123, § 36; c. 112, § 135B

Massachusetts law provides robust confidentiality protections for communications between mental health professionals and clients. Under Massachusetts General Laws:

​

  • Communications between a licensed mental health professional and a client are privileged and confidential.

  • Records may not be disclosed without written consent, except in specifically enumerated circumstances: imminent danger to self or others (Tarasoff-type duty to warn), child abuse reporting, court orders, and certain insurance/billing requirements.

  • You have the right to inspect and copy your records within a reasonable time following a written request.

  • Clients receiving services through telehealth from a Massachusetts address retain all state confidentiality protections applicable to in-person services.

 

Massachusetts Data Security Regulation — 201 CMR 17.00

Massachusetts has one of the most comprehensive data security laws in the country. Under 201 CMR 17.00, Anchoring Services is required to maintain a comprehensive Written Information Security Program (WISP) to protect personal information of Massachusetts residents. Our data security practices include:

  • Designation of a data security coordinator responsible for our information security program

  • Regular risk assessments of our data collection, storage, and transmission practices

  • Employee training on data security policies and procedures

  • Disciplinary measures for violations of our data security policies

  • Restrictions on access to personal information to those with a business need to know

  • Encrypted transmission of personal information across public networks

  • Reasonable monitoring of systems for unauthorized use

  • Up-to-date firewall protection and security software on systems handling personal information

 

Definition of Personal Information (MA): Under Massachusetts law, personal information means a Massachusetts resident's first name and last name or first initial and last name combined with any one or more of the following: Social Security number, driver's license or state ID number, or financial account number (with or without a PIN). Anchoring Services does not collect Social Security numbers or financial account numbers through our website.

 

Massachusetts Telehealth Clients

Anchoring Services holds active licensure to provide telehealth services to Massachusetts residents. Rebecca Zuehlke, LICSW holds Massachusetts licensure. Telehealth services provided to Massachusetts clients are conducted in compliance with Massachusetts telehealth regulations (M.G.L. c. 175, § 47BB; 211 CMR 37.00) and HIPAA. All clinical data for Massachusetts telehealth clients is protected under both HIPAA and Massachusetts mental health confidentiality law.

 

Massachusetts Breach Notification — M.G.L. c. 93H

In the event of a security breach involving personal information of Massachusetts residents, Anchoring Services will provide written notice to affected individuals and the Massachusetts Attorney General's Office as soon as reasonably possible, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore reasonable integrity of the data system.

We will verify your identity before processing any request. We will respond within 30–45 days depending on the type of request and applicable state law. We will not charge a fee for reasonable requests. We may deny requests that are manifestly unfounded or excessive, or that conflict with our legal obligations.

 

10.2 Opting Out of Targeted Advertising

You may opt out of interest-based advertising through the following:

10.3 Do Not Track

Some browsers transmit "Do Not Track" (DNT) signals to websites. Because there is currently no industry standard for how websites should respond to DNT signals, our website does not alter its data collection practices in response to DNT signals. However, you may use the opt-out tools listed above to limit tracking.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. SECTION 12: HIPAA & Mental Health Privacy - Additional Notice

Anchoring Services is a HIPAA Covered Entity. Our full HIPAA Notice of Privacy Practices (NPP) is provided to all clients at the start of services and governs how we handle Protected Health Information (PHI). Key points:

  • PHI includes any individually identifiable health information related to your physical or mental health, the health care we provide, or payment for that care.

  • We use and disclose PHI only as permitted under HIPAA and applicable state law.

  • We maintain a Business Associate Agreement (BAA) with all vendors who may access PHI, including SimplePractice.

  • You have the right to file a complaint with the U.S. Department of Health and Human Services (HHS) Office for Civil Rights if you believe your HIPAA rights have been violated: hhs.gov/ocr or 1-800-368-1019.

  • Filing a complaint will not result in any retaliation from Anchoring Services.
